Summary: The Senior Investigator varied the Hospital’s decision. He found that it was not justified in refusing access to the record at issue on the grounds that it does not hold the record sought for the purposes of the FOI Act. He found that it was justified in refusing access to a limited amount of information under sections 36(1)(b) and 37(1). He found that it was not justified in refusing access to the remainder of the report under sections 29(1), 35(1)(a), or 36(1)(b) and he directed the release of the record, subject to the redaction of the relevant financial information and of limited personal information relating to third parties.
