He annulled TUSLA's decision in relation to certain records, or parts thereof, as outlined in his decision and directed the release of the information contained in those records, subject to the redaction of any third party personal information contained in those records.

Summary: The Commissioner varied the decision of the Department. He directed that access to three records be granted in full. He directed that access to a due diligence report dated 19 December 2008 be granted subject to the redaction of information regarding individual borrowers. He directed that access to another report on the restructuring plans submitted by the major Irish banking institutions to the European Commission be granted insofar as it relates to Anglo Irish Bank. As one other report on Anglo Irish Bank had already been published on the Department's website, the Commissioner found that it fell outside the ambit of the FOI Act by virtue of section 46(2) of the Act. The Commissioner affirmed the Department's decision in relation to remainder of the records at issue on the basis of sections 22(1)(a), 26(1)(b), and 32(1)(a) of the FOI Act.
