Summary: The Senior Investigator upheld the Board's decision. She found section 37(1) to apply to the withheld details on the basis that they contained third party personal information about the claimant and/or other parties. She found that the public interest that the rights of privacy of the third parties concerned should be upheld outweighs the public interest that the request be granted.

Summary: The Commissioner found that he has the jurisdiction to review the Bank's effective decision to refuse the applicant's request for the records concerned on the basis that Schedule 1, Part 1 applies. He also found that a record falls within the scope of the Schedule 1, Part 1(b)(i) only insofar as it contains the information specified as excluded from the scope of the Act and that the parts of the record that do not contain Schedule 1, Part 1(b)(i) information fall to be considered for release in accordance with the provisions of the FOI Act. Accordingly, he annulled the Bank's effective decision and directed it to undertake a fresh decision-making process in respect of the records concerned.
