Summary: The Senior Investigator varied the Department's decision. She affirmed its refusal of parts 1 and 2 on the basis that the applicant has no right of access to the pre-commencement records sought. She annulled the Department's application of section 15(1)(a) to parts 3 and 4 of the request and directed it to make a new decision on these parts in accordance with the provisions of the FOI Act.
