Summary: The Investigator varied the HSE’s decision. She affirmed its decision to refuse access to certain information contained in the records on the basis of section 37 of the FOI Act. She found that, on balance, the public interest did not favour its release. She annulled its decision to withhold access to additional information under section 37 and to withhold another record on the basis of section 30, and directed their release. She also annulled the HSE’s effective decision to refuse access to additional relevant records on the basis of section 15(1)(a) and directed it to carry out a new decision-making process on parts 1, 2 and 3 of the applicant’s request. She also found that it had not justified its reliance on a neither confirm nor deny provision in section 35 of the FOI Act and annulled this part of the HSE’s decision
