Summary: The Senior Investigator affirmed ÚnaG’s decision to refuse access to the contract under section 35(1)(b) of the Act on the ground that release of the record would constitute a breach of a duty of confidence provided for by a provision of the contract.

He found that section 37(1) of the FOI Act (personal information) applied to most of the records but that the public interest weighed in favour of disclosing excerpts reflecting the nature of the LIS application and some aspects of the Council’s administration of the matter. He found that certain details, including the contractor’s name, were not exempt and directed their disclosure.
