She affirmed its decision to refuse access in full, or in part, to other records under sections 37(1) and 37(7) of the FOI Act, since the withheld information contains either third party personal information, or third party personal information that is inextricably linked to the personal information of the applicant. She found that the public interest in granting the request did not outweigh the public interest in protecting the privacy rights of those individuals to whom the information relates.

She found all of the records to be exempt under section 36(1)(b) on the basis that their release could prejudice the competitive positions of both RTÉ and McDonalds.
