Summary: The Commissioner found that he has the jurisdiction to review the Bank's effective decision to refuse the applicant's request for the records concerned on the basis that Schedule 1, Part 1 applies. He also found that a record falls within the scope of the Schedule 1, Part 1(b)(i) only insofar as it contains the information specified as excluded from the scope of the Act and that the parts of the record that do not contain Schedule 1, Part 1(b)(i) information fall to be considered for release in accordance with the provisions of the FOI Act. Accordingly, he annulled the Bank's effective decision and directed it to undertake a fresh decision-making process in respect of the records concerned.
