Summary: The Commissioner affirmed the decision of the HSE and found that Section 10(1)(a) applies as the records cannot now be found. However, in so doing he expressed serious concern that the relevant records which did exist cannot now be found in circumstances where no acceptable explanation has been given for their going missing.
