Summary: The Senior Investigator varied the Councils decision. She found that it was justified in refusing access to additional records having regard to section 15(1)(a) of the FOI Act. She found that the Council was also justified in refusing access to a small number of records under section 32(1)(a)(iv) of the FOI Act; however, it was not justified in refusing access to the remaining records under section 32(1)(a)(iv) of the Act and she directed the release of the remaining records.

She found that the public interest did not, on balance, favour their release. She annulled the Defence Forces decision to refuse to grant access to the remaining administrative records on the basis of section 35 of the FOI Act and directed their release.
