Summary: The Senior Investigator varied the decision of the Council. She affirmed its decision to refuse access to records relating to the personal information of third parties and/or joint personal information under section 37(1) of the FOI Act. She found that the public interest, on balance, did not favour their release. She also affirmed the Council's decision to refuse access to the majority of the records solely relating to the applicant's husband on the basis of the Freedom of Information Act 2014 (Section 37(8)) Regulations 2016 (S.I. 218 of 2016). She found that the public interest did not warrant the release of the majority of these records to the applicant. She annulled the Council's decision to refuse access to a small number of records on the basis of sections 30, 32, 35 and 37, and directed their release.

Summary: The Senior Investigator varied the decision of TULSA. He found that section 15(1)(a) applied to some parts of the request. He found that section 37 applied to other parts, apart from a small amount information in Parts 6, 12 and 22, and directed it be released, subject to appropriate consent being established to TUSLA's satisfaction. He annulled TUSLA's decision to refuse part 25 of the request under section 15(1)(i) and directed TUSLA to undertake a fresh decision making process on that part.
