Summary: The Information Commissioner varied the Hospital's decision. He found that names, specialties and sub-specialties of consultants, in the context of the request concerning compliance related information, came within the definition of personal information and were exempt under section 37 of the FOI Act. He annulled the Hospital's effective refusal of certain parts of the request and its refusal, effectively under section 15(1)(a), of access to other information. He remitted those aspects of the request to the Hospital for fresh consideration.

Summary: The Senior Investigator found that the HSE was justified in its decision to refuse access to the records on the basis that section 37 of the FOI Act applied. She affirmed its decision to refuse access to the records under sections 37(1) and 37(8) of the FOI Act. She found that in the circumstances of this case, the public interest in granting the request did not outweigh the public interest in protecting the privacy rights of those individuals to whom the information relates and the confidentiality of personal information.

She found that the records were created as part of a process of making editorial decisions or as part of a process of post-transmission internal review of programmes broadcast. She found therefore, that the records fall outside the scope of the Act, having regard to the Freedom of Information Act, 1997 (Prescribed Bodies) (No.2) Regulations 2000 (S.I. No. 115 of 2000).
