Summary: The Senior Investigator varied TCD's decision as follows. She found that TCD was not justified in refusing access to certain records under section 15(1)(a) of the FOI Act and directed TCD to take a new, first instance, decision on this part of the applicant's FOI request, in accordance with the provisions of the FOI Act. She annulled its decision to refuse access to certain other records under section 15(1)(c) and directed TCD to undertake a fresh consideration of this part of the applicant's FOI request, in accordance with the provisions of the FOI Act. She affirmed its decision to refuse access to records containing personal information relating to third parties, under section 37(1) of the FOI Act. She found that TCD was not justified in refusing access to two items of information under section 37(1) of the FOI Act. She annulled this part of its decision and directed the release of that information.

Of the details that had been considered and withheld, she found certain information to attract legal professional privilege and to be exempt under section 31(1)(a). The Senior Investigator directed the release of the rest of the information the Council had withheld under that section. She found all of the information that the Council had withheld under section 36 to be exempt under section 36(1)(b) of the FOI Act, but directed the release of parts of the records concerned under sections 36(2)(a) and 36(3)
